How we collect, use, and protect personal information under South Africa’s POPIA.

Last updated: 27 July 2026. This notice explains how Nexus Media Agency processes personal information in line with South Africa’s Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who we are

Nexus Media Agency (“Nexus”, “we”, “us”) is a South African digital agency based in Johannesburg, Gauteng. For POPIA purposes, Nexus is typically the responsible party for personal information collected through this website and our sales channels.

2. What personal information we collect

Depending on how you interact with us, we may collect:

  • Identity and contact details (name, business name, email, phone / WhatsApp number)
  • Project and enquiry details you submit via forms, email, or chat
  • Billing and invoice details when you become a client
  • Technical data such as IP address, browser type, device, and pages viewed (via analytics)
  • Marketing preferences if you subscribe to guides or newsletters

We do not intentionally collect special personal information (as defined in POPIA) through this website. Please do not submit sensitive medical, biometric, or similar data via public forms.

3. How we collect information

  • Directly from you (contact forms, WhatsApp, email, discovery calls)
  • Automatically when you browse our site (cookies and similar technologies, Google Tag Manager / analytics)
  • Through marketing tools such as HubSpot forms where used for lead capture

4. Why we process personal information

We process personal information where it is necessary to:

  • Respond to enquiries and provide quotes, mockups, or proposals
  • Enter into and perform contracts for web, software, and marketing services
  • Operate, secure, and improve our website
  • Send relevant service or marketing communications where permitted
  • Meet legal, accounting, and tax obligations in South Africa

Where POPIA requires consent, we will ask for it. Otherwise we rely on legitimate interests, contractual necessity, or legal obligation as appropriate.

5. Sharing and operators

We may share personal information with trusted service providers (operators) who help us run the business, such as hosting, analytics, CRM/email tools, payment providers, and professional advisers. They may only process information on our instructions and must protect it appropriately.

Some tools may process or store data outside South Africa. Where that happens, we take reasonable steps consistent with POPIA to ensure an adequate level of protection.

We do not sell personal information.

6. Retention

We keep personal information only for as long as needed for the purposes above, including legal and accounting retention periods for client records, then delete or de-identify it where practicable.

7. Security

We apply reasonable technical and organisational measures to protect personal information against loss, misuse, and unauthorised access. No online transmission is perfectly secure; please use strong unique passwords for any accounts we provide and notify us promptly of suspected incidents.

8. Your rights under POPIA

Subject to POPIA and applicable exceptions, you may request to:

  • Access personal information we hold about you
  • Correct or update inaccurate information
  • Object to certain processing, including direct marketing
  • Request deletion or restriction where appropriate
  • Withdraw consent where processing is consent-based

9. Cookies and analytics

Our site uses cookies and similar technologies for essential operation, performance measurement, and marketing attribution (including Google Tag Manager and related analytics). You can control cookies through your browser settings. Blocking some cookies may affect site features.

10. Children

Our services are aimed at businesses and adult decision-makers. We do not knowingly collect personal information from children under 18 via this website.
